I got a 10 day notice for not paying rent. Long story short, the reasons i didn’t pay is because there were a few sketchy charges and they aren’t really responding whenever I ask them about that (I’ve kept the receipts of me reaching out)
My question is, if i comply with leaving within the 10 days, will it be an eviction? my lease ends on the 31st, so if/when i do get sued, it will be for one month + whatever charges they tack on for “damages”
another question, i’ve already re upped my lease for this next school year (august – july) if i do breach this lease, does that null the future one?
i have no deposits on either one as this initial lease was a sublease, and they didn’t require one for reupping the lease. the process of the move out at the end of the lease is move out july 31st move back in august 15, FULL rent is due on august 1st even though you won’t be there for a full month. so, i’m just not really wanting to continue working with the company because random charges are getting tacked on.
this is how the notice reads,
“You are hereby given Notice that you are behind in your Rent payments. You are required to either pay the total amount owing as indicated below or move out within TEN (10) DAYS after the service of this Notice.
You are required to do one of the following:
• Within TEN (10) DAYS you must pay which consists of..”
“Within TEN (10) DAYS you must vacate the Premises you have rented. By electing to vacate the Premises, you will not be released from your obligations under the Lease.
If you do not comply with this Notice, legal proceedings will be instituted against you to recover possession of the Premises, to recover all rent past due, and to recover court costs, attorney fees, and statutory damages as permitted by law. Delay or postponement of such action does not waive Landlord’s rights.”

Will it be? Who knows.
Can you still be evicted for non-payment of rent after your lease ends? Yes. You can be.
You may not get an eviction on your record. But be prepared for the landlord to sue you for back rent, any damages to the unit and legal fees as well as possible more since you signed a new lease.
