Can I take legal action against my landlord? I have lost sleep so many times due to the airbnb that is next door.

Location: Jackson county MO, specifically downtown Kansas City. Basically I have on many occasions been kept up or woken up by the Airbnb next door to my apartment. I have many documented videos of those who stay there being extremely loud past what is supposed to be quiet hours. On one occasion I even called the police. I had mentioned to the building office at one point that the particular people staying at one point were yelling outside and inside, smoking marijuana (which I don’t mind personally but in our lease since it isn’t federally legal it’s banned from the building), playing loud music past quiet hours. I have all of those occasions on video as well as many other instances from different groups staying there. Is there any action I can take?

    Does the landlord own/run the Airbnb? I’m not understanding what this has to do with your landlord.

    The actions you could take would be against the owner of the apartment next to yours. If I were you I’d be doing everything I could to make this an issue for the building and owner of that apartment. File noise complaints every time the quiet period is broken both with the building and police. You may also want to start documenting when these occur, ideally with a sound meter to measure volume, which can be the basis for county/city fines for the owner.

    As others have said, you likely don’t have recourse with your landlord, unless they own that apartment. If they do, you can try speaking with them directly, or if of interest, see if you can break your lease based on not allowing quiet enjoyment. But lots of that will be specific to your lease and locality.

    The way you worded it makes it seem like the Airbnb is in a different building, but if the Airbnb is in the same building and building management has set quiet hours then they should be enforcing them.

    Keep documenting, calling the police, complaining to Airbnb, and if it’s in the same building as you, notifying building management – every time.

    Make it a big enough pain in the ass for Airbnb and they might just remove the host.
