Employer overpaid me. Confused on whether to pay back gross or net? MI

r/

I’ve seen a lot of conflicting info regarding this question. My employer overpaid me last pay period. I am agreeing to have them deduct the overpayment from future paychecks over time to lower the financial burden.

They are requesting I pay them back the gross amount, and saying they will take the deduction from my gross pay on future checks, making the taxes even out long term.

I’ve seen other posts online, (including documents from universities), outlining their own rules and practices for if this happens, and saying that they take the net amount back, and then the employer has to recoup the tax portion by their own means.

Is there a “right” way for this to be done? I’d prefer to put the onus on them to correct their mistake so I’m leaning towards the net amount but they are asking for the gross. If we do the net, does it get deducted from future gross or net pay?
