Location: Queens, NYC.
The above is the settlement. $3750 over 7 months, paid in $500 increments on the 15th of each month.
I originally tried to sue her for $7983 but settled with a mediator at $3750 so it did not have to go to trial before a judge, and I just wanted it to be over.
The agreement says she is to pay me $500 by the 15th of each month via paper check (she lives in TX, I live in NY), or else she faces the $7983 if I file an Affidavit of Non-Compliance within 10 days of not receiving the funds.
I’m assuming these checks just need to be postmarked on the 15th, or how does that work exactly? If I get a postmarked payment on the 16 of a month can I file for Affidavit of Non-Compliance?
1st time doing this and the clerks were not helpful at all so any advice would be greatly appreciated.
