Upstairs neighbor fired a gun into his floor/my ceiling. Now what?

I live in a large apartment complex. A few days ago, my upstairs neighbor was being incredibly loud, banging on the floor and generally being tweaky. Eventually, we heard a gunshot and the police showed up. They broke down the door and brought the tweaky neighbor out strapped down on a stretcher. He managed to shoot himself in the foot, and the bullet went into his floor. I don’t think it punched all the way through my ceiling – cops came into my apartment to check for bullet holes and did not find one.

I’m worried about living underneath someone that obviously cannot control their firearm. He’s at the hospital right now. I asked the complex what steps they were taking in regards to this and they are being very very cagey about it. I have requested a copy of the police report from my local PD, but have not yet received it.

Is there anything I can do about this? I am not comfortable living underneath this idiot and the complex won’t say whether or not he’s being evicted.

    Now you let criminal justice take its course.

    There’s no harm in asking landlord for release from your lease. You can’t force that here.

    The complex is going to still have to go through the eviction process on this one. It could take a few days if the tenant leaves on their own. Or if they buckle down and want to be stubborn it could take weeks. But firing off a gun in their apartment is almost certainly going to eventually get them evicted.

    Have you asked the leasing office if there is another unit you would be able to move to and if so what did they say to that?

    The landlord can press eviction quickly if they want. I believe it’s a 3-day notice for eviction for illegal activity and mishandling a loaded weapon like that, especially indoors, would certainly not be a stretch for illegal activity. They may be evicted by the time they’re let out of jail if you’re lucky.
