Apartment complex promised one free month and now wants me to pay

Hello, I recently moved into an apartment with my boyfriend. This complex offers “move in deals” on their website and they almost always have a special going on. We moved in the middle of the month on August 15th. but did not apply for the apartment until the day before, August 14th.

They had a deal that was one free month on qualifying apartments if you sign by August 24th, I saw this and screenshotted it on August 14th. When speaking with the leasing agent over email I had asked her multiple times about this and made sure we would qualify. She told me that if they had any specials going on that it would apply. I tried to press more about this to ensure that we would qualify and even asked her if it would be applied to August or September. She did not respond to these emails because she was out of town for 3 days after we moved in. Mind you, she tried to push out move in date back to after she was back so she didn’t have to rush the process on a Friday even though I had explained we had a definitive move in date.

When she got back, she responded and let me know that someone else would be sending over a concession addendum for us to sign and get one months rent free. Shortly after I received an email from a different company about the apartment that I thought was the addendum, but turns out it wasn’t, so I didn’t think anything of this until September 1st came.

Today I was doing my budgeting and went to double check how much our rent ends up being with trash, insurance, etc. and saw that I was due for September and now late. I sent my leasing agent and email, to which she asked me to call, and she let me know that basically the apartment didn’t agree to give us a free month. Now we are being told we have to pay for September and they’ll waive the late fee. This entire time we were under the impression that we would receive this free month because I haven’t been told otherwise despite asking multiple times. When I did get a response, it felt like she didn’t know who she was talking to.

I’ve since sent her screenshots of her miscommunication and the deal that was posted on their website about signing before the 24th. Is there any ground I have for their mess up? It’s not really fair that they jibbed me like this.

    Is it in writing? If so I’d look for multiple proofs of them saying this. Did the period for this expire? Make sure you start making a paper trail and then go take that up with an attorney.
