I’m currently based in GA and the position is in Virginia. I invite you to read my prior post history for more flushed out context on my FCRA experience. Long story short
I accepted a job offer
Bg check started.
I received a PAAN, but no context as to what was wrong since there was no criminal record on the bg check
I reached out to the hiring company and bg check company who both provided no context but to wait.
I received an adverse action notice from the bg check company stating the hiring company has taken adverse action. Again, no context or reason why. Hiring company did not respond to inquiries
Multiple calls to bg check company and eventually someone actually pulls up my file and sees it’s because my SSN appears on the master death file.
I immediately know what’s up. In 2023 I was marked deceased by SSA. I rectified this almost immediately or so I thought. Either they didn’t clean it up properly or i…
Social security just called me. Confirmed I’m not on the master death file. So idk what’s happening. I’m having them regenerate the letter I received when I first fixed this and going to give this to the employer.
Were my rights violated? I feel like not being told WHY I’m at risk of adverse action so I could correct it was wrongfully done.

No.

There are a lot of laws and regulations about how they communicate with you here. What happened when you reached out to the hiring manager or recruiter and said “the only problem I could possibly have would be an error in me being in the death file and here’s proof that I’m not, let me know if you need something else?”
Nope, no recourse. Just make sure to fix the death index.!!
