My girlfriend bought a used online car to be delivered from a Florida dealership to Georgia 30 days ago ($2500 down payment and $7500 loan through a bank) and they verbally agreed to deliver the car in the next few days. 30 days later, and the car still hasn’t been delivered. The dealership has repeatedly made promises of car delivery in the next few days but consistently fails to do so. The purchase agreement says nothing about delivery time.
Can we cancel the bank loan and receive our down payment back from the dealer? Will the dealer push back on this?
