AITA am I the nightmare neighbor

r/

I am (f22) and my neighbor is (m40-50) live on the top floor and he is right beneath our apartment and i believe possibly others apartments because he’s in the corner like me. My living situation is my cat me and my (m25)fiancé. His i believe is him and his wife who I’ve never seen but he mentioned. First week in the apartment we weren’t sleeping there just yet bc we were still moving stuff in (only moved stuff in during the DAY TIME). He two nights into us actually sleeping in the apartment he came up to our apartment and he came to our door while I was the only one home and said that he wanted me to come outside to talk I told him “wrong apartment” bc I didn’t know he was my neighbor he explained he was and repeatedly asked me to open the door to him and after I told him no because he sounded very angry and I didn’t know him and can hear him fine through the door he explained he had filed a noise complaint against me I asked him why and at first he didn’t want to tell me but I eventually got the awnser that it was “walking at night” and that he gets up around 6am for work and it’s very disrespectful to his routine I explained to him that I understand that he doesn’t like us walking at night but we get back home from work at 3am and we can’t just not walk into our apartment but we could find him a solution like a brown noise machine (I have one) after I made that comment he was pissed said he had people he can call and I told him so do I and we both left it at that after I called the landlord about him trying to get me to open my door and that it was uncomfortable because I don’t know him they said they’d have a chat with him about that and then I see two months later I have a noise complaint for excessive noise and failure to observe quiet hours and got one again last night and yes I have been calling my landlord they said it was because I’m walking at 4am and they no longer plan to repeal the warnings and they still got more last night

AITA is it actually bad to walk around late at night knowing ur the top floor?

OP has offered the following explanation for why they think they might be the asshole:

    > I felt I was rude to my neighbor in the conversation we had. By reporting him to the landlord for talking to me and the secound bc I’m still walking around late at night

    Info:

Do you wear shoes in the house? This can make a difference.

NAH, it’s a bad situation all around. Quiet hours are there for a reason, but if you get home late at night that’s just how it is. I suggest looking into solutions for the noise like getting rugs or house slippers etc.

NTA. You are allowed to walk around your apartment, in shoes ANY time of the day. As long as you are not purposely stomping then you are doing NOTHING wrong. Tell the landlord that his com[plaints are not based on facts and you will happily go to court if needed. And since when can the apartment ABOVE you hear when you walk around? He’s old and hateful and looking for someone to mess with. So ignore him.

It’s bad if you know you’re making a lot of noise and aren’t taking measures to reduce the noise.

If the floors are super old and creaky that’s the building, not your fault. OTOH if you are wearing shoes on hardwood or vinyl floors or just walking heavily and making loud footfalls, that’s your fault.

If you work a late schedule and you know you get home when your neighbor is trying to sleep, it’s worth making an effort to be quiet- to walk softly, not drop your work bag or groceries or shoes on the floor.

Maybe try wearing house slippers; they made a big difference for me. I tend to be a very fast, “stompy” walker, with heavy footfalls, but wearing slippers helps me adjust to walking more softly.

Seek Legal Advice… You can’t be told you can’t walk around your own apartment during the night. If you have hardwood floors, get rugs it might help but you are under no obligation to not enter your home.

ETA: Double check your lease, quiet hours usually means loud TV’s, Musics Etc… Not moving around.

NTA. Buddy needs to accept the fact that this is part of what comes with living in an apartment. If you never want to hear any noise caused by neighbors buy a house and sound proof it.

Personally I understand not wanting to open the door, but unfortunately you made it where he can’t approach you if you’re making noise, he has to report you. If y’all were able to have had a civil conversation and figure it out, he may have never made further complaints, just let you know if it became excessive any nights. I know he could have also just as easily still made the reports even if you had gone out and talked to him, and he may have been difficult no matter what. But the way you went about it by not opening the door then followed up with complaining about him approaching you, now results in that his only option is to escalate the conflict with management every time.

NTA. You’re allowed to walk in your own home, even at 3–4am. That’s normal life, not “excessive noise”. Him demanding you open the door was out of line and honestly you did the right thing by reporting it.

This is such a frequent problem.  I’ll just go NAH since I have no idea how the noise sounds from his apartment; but it’s kinda crazy how often this specific thing comes up.

You are entitled to walk around in your apartment.

From what you’ve described, you aren’t making any sort of extreme or unusual noise.

    He’s being whiny.

    NTA.

ps> If your landlord tries to take action on these goofy noise complaints, talk to whatever local government agency oversees housing/rentals.

NTA, but put down some heavy rugs if you can.

I guess that depends on how you walk? If this apartment complex has bad noise separation between floors which it sounds like it does… Are you walking around in flip flops smacking the floor? Do you walk heavily on your heels that for all intents and purposes you are stomping? Wooden clogs? Lol, I’m being little facetious here but if you were actually being loud i can see that making you the AH. But, simply walking around is a noise that’s part of life. I also work shift work and alternate between sleeping through the day or getting up at 4am and i wear ear plugs and run a fan near my head to drown out the kids heavy heel walking around the house so i kind of feel his pain if you are a loud person. I also feel like there should be better sound dampening between apartments..

Imo, ppl who complain that they can’t sleep due to noisy neighbors, are ppl who have sleep issues that is only exacerbated by the noise. This guy needs to figure out what’s wrong with him (why he’s not sleeping). He’s the problem. You can’t blame your sleeping issue on “noisy neighbors.” Because I sleep on an enclosed porch. I hear everything when I’m awake, but once I’m asleep I don’t hear anything. Tell him to add some white noise.

  17. Deciduous-Jellyfish Avatar

NTA, assuming you’re walking gently (being conscious of the fact that you get home from work in the middle of the night). Hearing neighbors is a part of apartment living. Would he complain if you walked to use the bathroom in the middle of the night? I find it hard to believe that his previous upstairs neighbor never did that. If his sleep issues are so severe, he should have moved to the top floor.

  18. GloryIV Avatar

People like this guy need to have a top floor apartment or a house. Assuming you weren’t stomping around, you are NTA.
