    Yeah they should, but the other half of that is that people shouldn’t be forcing 200 legal challenges and obstruction to due process when people are guilty and ought to be deported.

    When the system breaks down, people stop using it basically and it takes goodwill from everyone to make things work well enough for all to change that.

    Everyone gets due process, or no one does. If they can accuse you of being a gang member to deny you due process, suddenly everyone they don’t like will be accused of being a gang member.

    Judges are a restraint on the unlawful exercise of power. The only reason to circumvent them is to abuse power.

    It is guaranteed to EVERYONE that is prosecuted by the US Government, whether they are a citizen or not.

    It is one of the base reasons we rebelled against England and King George III.

    Nope. The only “evidence” the government should need is proof of illegal entry or no proof of legal entry.

    By no proof of legal entry I mean that the government does not have documentation that said individual entered the country in a legal way and that the same individual cannot provide any documentation to show the government that they were indeed legally allowed to enter the United States.

    If any group of people is not afforded due process, no one in the US has a guarantee of due process. If they’re saying gang members don’t deserve due process, they can label anyone they want a gang member, and then “deport” them (deportation without a hearing is much closer to just being kidnapping). So, even if you want every gang member in the US to be disappeared, you should have a long hard think about cheering on the erosion of due process

    Trump voter here. Yes absolutely. Everyone should be entitled to a fair hearing and due process in this country. I’ve been really disappointed and concerned about the way Trump and Tom Homan have gone about deportation. I agree that if you came here illegally you should be deported back to your country of origin AFTER a fair court process. Without due process how are we not a dictatorship?

    Absolutely no one should be sent to a prison in El Salvador by the US government.

    The US government should either deport the individual back to their own country of origin, and let them deal with whatever happens on that end, or if they have committed a crime within the United States they should be judged in a court of law within the United States imprisonment, if that is the finding of the jury until their time is served and then be deported to their country of origin

    There is no way we should be sending Venezuelan’s to a prison in El Salvador

    Just the fact of being in the United States on documented, does not deserve the severe punishment of being put in a high security facility. Anyone who is undocumented should have the choice to leave the country immediately on their own dime and with their own arrangements, and if they cannot do that or will not do it, then they should be simply deported back to their country of origin.

    It is in the constitution that both persons (meaning ANYONE standing on US soil) and citizens are entitled to due process of the law

    A lot of the Trump administration will be seeing the inside of a prison cell, unless they manage to actually turn the US into a full blown dictatorship and the country is ruled by the Trump dynasty for the next 50 years. Sadly I think old Donald will drop dead before they can put him in chains.

    No. If they are illegal aliens and are from El Salvador or a country try that refuses to take them, they can by law be deported to El Salvador. Being illegal doesn’t allow you to stay in the US permanently if you don’t join a gang or commit additional crimes beyond violating immigration law.     Should people be send to a prison, without a trial? Should people be send to prison, without informing them what the length of their sentence is? Should people be send to a prison, that is not under the control of the entity that passes judgement?

    It’s a sign how far the USA has fallen, that the answer isn’t obvious. I see a lot of mentions to the constitution in answers that rightfully say that this should not be done. 

    But I’m not American and I don’t really care if this is legal in the US or not. It’s wrong. It’s evil. No matter what your president, your supreme court or your congress says.

    This is a very broad question. If a person entered the country illegally and is undocumented then they don’t have much recourse to being deported for any reason. For all other cases the person has the right to due process.
