Child injured in school (Pennsylvania)

Friday (May 30, 2025) My daughter fell down in gym class and after attempting to get up, she was pushed down again resulting in her rolling her ankle. This happened at 9 am, she said she went to the nurse and the nurse told her that she may have sprained it. I was never called and my daughter had to walk all day on her injured ankle. We saw a doctor today (May 31, 2025) got an x-ray, but because she is so young, they couldn’t tell if she has a growth plate fracture or not so they put her in a boot. We have to wait until Monday to see an orthopedic doctor to determine fracture. Her school is 2 stories, her being on the top floor and having to walk the stairs up and down all day for different classes/dismissal may have worsened the injury.

I did look up the school’s handbook and can’t find anything on if a parent should be notified of injury. My question is, what should my next step be after speaking with the school themselves? Is this grounds for a lawsuit? I know public schools have some sort of immunity from lawsuits so unsure if that’s a possibility.

    Obviously we don’t know what your daughter said to the nurse or how she got to “be careful.” But it sounds like there’s room to question whether this person did the right thing or needs some additional training.

    It doesn’t sound like there’s a suit here. Or likely a loss for which the school might be liable.
