If you are slumped over the table drooling, and the dealer says “if you don’t want to bet $100, please tell me” and then takes your lack of coherent refusal as consent, taking a stack of your chips and putting them into play, odds are you could get a judge to say that the casino stole that money from you.
American here, I cannot speak to the gambling aspect, but to be too drunk to consent to sex is a very high bar. This bar is way higher than being legally intoxicated for driving and the onus is on the prosecution to prove that the sober, or at least more sober, person could tell that the other person was unable to provide consent.
It’s an interesting thought exercise, I knew a guy who doesn’t drink anymore because the last time he did some dudes forced him to withdraw thousands of dollars from an atm and then robbed him and the bank was like sorry we can’t do anything because you withdrew the money on your own accord

When you hear cases of someone being raped while drunk it’s when they’re so drunk they can’t resist or are straight up passed out. The misconception is basically pushed by bitter men trying to make a point out of what they think is evidence of unfairness in the system.
As far as casinos they definitely use intoxication to their advantage as a way to make money but they’re not letting a limp bodied drunk go all in on blackjack lol.
