My car got hit and the person at fault is suing me for their damages

r/

Quick breakdown, I was pulling out of my driveway and I had checked left and right for no cars, as I am fully stopped and switched gears, a person comes in speeding and hits the side of my car, the police arrive and they were found to be at fault since they were distracted by their phone and child. They didn’t have good insurance so my company had to cover all of my damages but not theirs since they were at fault. They are now suing me personally for the damages that they caused to themselves and the court date lands on the exact time as my final exam. I am a college student with very little savings and I have no idea how to go about this. How are they able to sue if they caused the accident and the damages and we’re at fault and what do I do in this situation as I cannot afford a lawyer.

Your insurance company will appoint you a lawyer but send them all the court documents ASAP

    That’s what insurance is for.

Your insurance company will handle this. Btw, cops don’t assign responsibility in the way you are assuming they are. The insurance companies discuss that.

You’ll definitely need a lawyer for this, there’s no way around that.

Hopefully you contacted an attorney and your insurance company but mostly your insurance company because they will appoint an attorney to defend their interest and yours that’s what there job is!

You needs the documentation that the driver was distracted. It’s very important.!

I live in an unmarked intersection. There is a stop sign, but nobody sees it because of the weeds and the other people coming. Cannot tell that there’s an intersection at all so every time the person pulling away from the stop sign with the people flying around the corner, who don’t know there’s even an intersection collide and every single time no matter what I witness The poor person who is going through the stop sign who actually did stop they saw the sign, but couldn’t see the speeder coming, and the speeder didn’t know that there was an intersection collide, and it’s always winds up being the fault of the person with the stop sign who is pulling forwardso you absolutely need the documentation that the driver was distracted. Otherwise you were just pulling forward from a place that you should’ve been stopped. I hope that makes sense.
