We generally have agreed as a society that minor’s are not cognitively developed enough to make major life decisions. Hence parents / legal guardians come into play.
That being said, teenage pregnancy has enormous long term implications for a young girl. Parents/guardians of course are not perfect and may force their warped views on said kids.
I think that if the legal argument is that it requires parental consent or a judicial waiver, the latter should be clearly and easily obtained. There are absolutely terrible parents out there who feel zero guilt if their kids die from being denied vaccines or medical care, and a scared teenager should have a simple legal path forward to override problematic parents via the legal system.
And it should not require any in-court time, nor legal representation. It should be a simple form. Mail-in or online application.
>The law requires any minor seeking an abortion to obtain parental consent or a waiver that can be sought from a judge in certain circumstances.
>The state court ruled that “a minor’s right to control her reproductive decisions is among the most fundamental of the rights she possesses” and the state had failed to show how its own interests overcame those protections.

I’m a bit mixed here.

For a moment I thought that said you need prenatal consent from “minors” for an abortion.
