My sister in law has been living in my house for about 2 years. We initially let her stay because she was healing from a major injury and could not work. Which we all (even one of her doctors) thought would be about 6 months. She watched our baby until he got over her weight limit and now she is becoming a burden to the overall mental health of the household. I verbally let her know that we are planning to evict her and she went on about how we legally could not because she needed a safe space for her son when she had him – which is usually a weekend or 2 per month or she would lose custody. She has not had him since april and does not have income.
Does this hold precedence or can we potentially continue?

You can’t evict her until you give her written, 30-day “notice to vacate.” If she’s not gone 30 days after that, you take her to court to evict. The custody thing is her problem.
