My soon to be ex husband. Is trying to make it mandatory for our child to come over and spend the night, but she is uncomfortable. I am scared this is going to be an issue during court. Will they take what the child wants in consideration. There is no parent plan in place, and no legal custody establishment.
Also, is he legally as of right now to come get her when ever he wants even she doesn’t want to go?

And how old is she? Courts will handle this quite differently if she is three versus sixteen.
