Dental Malpractice Suit? Baltimore, MD

Location: Baltimore, MD, Long story short, my husband saw a dentist in 2022 had like 3k worth of work done to his teeth according to them, in 2023 his teeth started to feel brittle and he had always had good teeth, he went to another dentits that told him he needed 3 root canals, but he mainly went because he was having a lot of pain in tooth #7, he went to the oral surgeon and he assumed he did everything that the dentist said he would do, fast forward a month later he goes back complaining of the same pain in the same tooth only worse, come to find out the dentist only sent a referral for 1 tooth and it wasn’t even for the one he initially come to him for with the most pain! He then told him some bullshit and convinced him he needed crowns on several front teeth and drilled holes in them to prepare him for the crowns and took impressions. During this time he got extremely sick, so sick we went to the primary care doctor who told him his labs were off the charts, he was basically almost septic at that point and said that if he wasn’t in such good health and good shape he wouldn’t even been able to make it there. His liver was actually inflammed from the infection in the tooth. He then went to a different dentist to have the original tooth looked at and get a second opinion, not only did that tooth need to be pulled and have extensive work done on the bone, he told him that he had to pull one of his FRONT TEETH and that several more top teeth would have to be pulled, could not be saved and that his only option was to get implants after that that cost between 15-30k! He was shocked because this other dentist was about to put crowns on these teeth and now this dentist is saying even if you paid me 80k I would never put crowns on your teeth, you would be back within 12 months complaining of pain and basically said the first dentist was negligent that he shouldve never told him he could save the teeth, mind u not even 2 yrs ago his teeth were fine and now they need to be pulled out! Needless to say my husband was upset, he is young and he’s never had bad teeth or dental issues like this. He saw the original dentist almost 7 times in the course of those 2 months and he was not only mislead but basiaclly lied to by telling him he was ok and could save the teeth and was more interested in getting our money for the crowns that he totally forgot about the original infected tooth. He was in bed for over a month sick and septic, had to be hospitalized put on extensive antibiotics, missed work and was so sick he lost about 30 lbs during that time. I have heard filing a dental malpractice claim is not easy and we are about to file a complaint with the dental board but I strongly feel he has a case against this guy and the new dentist has said he will go on record and say that this was negligent and should’ve never been told he could save any of the teeth. When we confronted the dentist they basically told us that they had no record of my husband complaining of pain in that tooth which is the whole reason he went there in the first place! Not only that but I feel like if you are a dentist and medical professional I should’nt have to come in and tell you what the issue is, if you are a good dentist you should see the issue very clearly, I’m no dentist but even I could see this was badly infected and he saw this guy over 6 times! Then we tried to get his medical records they told him he had to come in person because of HIPPA. This dentist is known for working with recovering addicts and now I think I know why because he expects that people don’t know what he is doing to them especially if they haven’t had dental work done for years and don’t know any better so who better to target then recovering addicts. I think this is despicable and he should not be working on anyones mouth at all. I have put a consult in for a dental malpractice suit but I have heard it’s much harder than he normal medical malpractice suit. My husband doesn’t think anything will happen but how can this be ignored?! Now he has to spend 15k on a whole top row of implants not to mention the missed work, and pain and suffering he caused. My husband came home crying when they told him his whole top teeth basically had to come out, and if he would’ve continued to go to this guy he would’ve put crowns on top of teeth that were needed to be removed! How can this happen? Do we really have a shot at this? I do believe he should be responsible to pay for the all the new implants, the missed work, and suffering and I whole heartedly do not feel like he should be a dentist and get to do this to another person! We trusted this guy and were about to take our kids there too! I just need some advice am I wasting my time with a malpractice suit or should I continue to try to make this work because after paying for these implants we are spending alot of money and I don’t know how this works.     Medical/dental malpractice is beyond casual online advice here or anywhere else.

    If you want to find out if you have anything actionable you are going to need to start calling around to med mal attorneys practicing in your state to see if any bite.
