We are starting daycare soon for our one year old, and I was reading through the daycare contract. The clause below caught my eye because it felt like the daycare is saying they aren’t responsible for any actions/mistakes made by them or their teachers. Is this normal for daycare to say? Seems silly to not take any responsibilities for actions on your premises? Makes me want to not send the child to daycare.
“Client(s) agree to indemnify and hold harmless SSNS and their directors, attorneys, stockholders, affiliates, officers, agents, employees, successors against any and all third-party claims, including without limitation, any claim for negligence, losses, damages, liabilities, penalties, punitive damages, expense, and cost of any kind or amounts whatsoever, which result from or arise out of any act or omission of SSNS, its respective directors, attorneys, stockholders, affiliates, officers, agents, employees, successors, and assigns that occurs in connection with this Agreement. In the event that any claim is brought by, or asserted on behalf of Child against SSNS, Clients) shall indemnify, defend and hold harmless SSNS, and any of SSNS’s respective directors, attorneys, stockholders, affiliates, officers, agents, employees”
