Hello everyone, so 9 months ago I was operating a company truck when this happened, I was found at fault for improper lane change, no ambulance was called and I had no citations or tickets
Today I received the notice that I am being sued by the other person insurance (Allstate) they basically want around $12,000 to recover what they paid for the damages
I no longer work for this company and the company is also being sued according to what I received
I don’t really know what to do from here since I don’t even have that kind of money.

Reach out to the company and get the contact information for the attorney that their insurance is providing them.
Then talk to that attorney, who will likely also be representing you.
The liability insurance that was in place at the time of the accident should defend and/or cover this. It doesn’t matter that you no longer work for them, as long as there was a policy in place at the time of the accident. Get in touch with the insurance company that had the policy in place at that time.
The plaintiff has likely zero interest in you. I would be shocked if you weren’t covered by the huge policy the company has and you were the agent of the company.
While I am not a New Jersey lawyer, I would be shocked if there wasn’t a duty to defend and cover you with the insurance under either the policy, law, or both.
If the company wants to wriggle out of it and say you weren’t in the scope of employment(drunk, on a “frolic and detour”), the insurance company probably has to provide counsel to defend that as well. Those aren’t common unless you were drunk and were waaaaaay of course of what you were supposed to be.
The thing you must do is notify the company of service so they can notify their insurance company so they can answer the complaint on your behalf.
Seems like a subrogation that turned spicy between the insurance companies.
