Topic: Landlord/Tenant Rights – House Showings While Occupied
Situation
- We rent a house until August 1st (lease ends then).
- The owner is selling the house; our landlord is a realtor and installed a lockbox.
- We have two dogs and were told there would be a schedule for showings so we could be home and manage the dogs.
What Happened
- Twice in one day, people (including a realtor who was not our landlord) entered the house without knocking or a scheduled appointment.
- The second time, my partner was in the restroom and his dog (a large mixed breed) ran out the front door when the realtor entered. Small children were waiting to view the home.
- We are worried this could happen again, especially since we both work outside the home and can’t always be there to manage the dogs.
Communication Issue
- After the incidents, my partner (who is on the lease) contacted our landlord, who responded by saying she didn’t know how he got her number and to never contact her again (she told me the same).
- We have made a report with our local police department.
Our Concerns & Questions
- Entry Issue: What legal steps can we take to prevent unauthorized entry for showings?
- Lockbox: Can we request the lockbox be removed, or install a slide lock/other measure until we move out?
- Communication: Is it legal for the landlord to refuse to communicate with a tenant? Can we require a group text or other method to coordinate showing times so we can plan around work and keep our dogs safe?
Additional Details
- We do not have crates for the dogs and don’t feel we should have to buy them just for showings. The original arrangement (us being home to manage the dogs) worked best.
- We’re out of here in about 24 days and just want to keep everyone safe until then.
- Not sure if we qualify for legal aid due to our combined incomes.
What should we do next?
- What legal rights do we have to prevent further unauthorized entry?
- Are there steps we can take to enforce proper notice and communication?
- Is there a way to require showings to be scheduled and supervised?
Any advice or similar experiences would be much appreciated!
