My wife and I are very punctual with our bills. We always pay on time or early. Well today we received a summons from our local municipal court. It was for my wife, it had her name and her address but it was a different middle initial. It was for a store credit card balance. We have never been in this store. It’s not even a store that is near us. The bill for the credit card named this person who has the same name as my wife but different middle initial as someone who lives in SC. I attempted to call the attorneys office who sought the summons and they asked for my wife’s DOB we provided it and they said it didn’t match and there wasn’t anything they could do. It says we have 28 days to respond to the summons. What is your best advice? Should I get an attorney? To be honest I am very annoyed and upset by this whole situation and how unprofessional it has been handled by the attorney seeking the debt.

She (not you, unless you are a lawyer) should write a letter to the lawyer and explain that she is not the same person and provide proof of that. She should demands that the case be dismissed, and if it is not dismissed within 10 days, that she intends to [file an answer/hire a lawyer to file an answer] and ask the case to be dismissed [and to be awarded her attorney’s fees and or costs if applicable] based on the lawyer persisting with a case that he now know is against the wrong defendant.
