I own the CPAP machine. I was misdiagnosised and have had it sitting for a while. I was told it was illegal or not allowed to sell them. So I want to give it away. I tried calling sleep centers and they haven’t accepted. Is there a way to donate these to someone in need in my area who needs it but can’t buy/get coverage? I won’t make a penny. I just want them gone but can’t in my heart throw it away since so many people suffer from sleep apnea and can’t get a CPAP. What can I do not to run into any legal trouble?

It is illegal to resell a CPAP machine to a person who does not have a prescription for one, as they are Class 2 medical devices. You could sell it to someone with an authorized prescription.
But, selling a medical device has it own potential for extra liability. The best answer is to donate it to an organization equipped to handle them. There are quite a few charities and other not-for-profits that accept such donations. Choose one that you are most comfortable with and donate to them.
