Need Help: Budget Charged Me Over $6,000 After Accident, Despite LDW Coverage

I recently rented a car from Budget for a short 2-day trip — picked up on June 1 in Buffalo, NY, and returned on June 3 in Toronto, Canada. During the rental, unfortunately, the car was involved in an accident. Location: Buffalo, NY, USA (car picked up) / Toronto, ON, Canada (car returned)

I had purchased the full Loss Damage Waiver (LDW) at the time of booking, assuming it would protect me from major financial liability, especially in the event of an accident.

To my shock, Budget charged me $6,863.80 USD, and here’s the breakdown:
• Base rental for 28 days: $2,583.64
• Late fee: $540
• Misc charges: $510
• One-way & other fees: $500+
• Taxes and fees: $1,000+
• Insurance add-ons: $1,100+

When I looked closer, I realized they charged me for 27 additional days, claiming the car was in the repair shop for nearly a month, and that I was responsible for the “loss of use” during that time.

But according to Budget’s own LDW policy, it says:

“If you accept full LDW and the car is operated in accordance with the Agreement, we assume responsibility for the loss of or damage to the car…”

Nowhere was it made clear that I’d still be liable for weeks of rental charges just because the vehicle needed repair.

I feel like this completely defeats the purpose of buying LDW. I’ve emailed them to dispute the charges, but I’m wondering:
• Has anyone experienced something like this?
• Is Budget allowed to charge me for “loss of use” even with LDW?
• Any advice on how to get this refunded or escalate?

    Sounds like you need to consult either your private insurance or an attorney.
