Looking for advice or stories from others who’ve fought removal despite having a criminal record.
I’ve been in the U.S. since I was a baby, brought here as a refugee from Southeast Asia after the Vietnam War. I’ve lived here ever since — over 40 years. I’m married to a U.S. citizen, have U.S. citizen kids, and work full-time in construction. We own a home and live a stable life.
But over 25 years ago, I made serious mistakes. I was convicted of a violent felony and later a federal offense. I served my time. I’ve been clean and focused on family and work for many years.
Now I’m facing removal. I was previously released from ICE custody due to travel document issues, but things have changed and I’m back at risk. I have a final order of removal.
My lawyer is filing a motion to reopen and possibly a waiver based on:
• My original refugee background
• Over 40 years of residence
• My U.S. citizen family
• My health condition
• The hardship removal would cause
Do people actually win these kinds of cases? Or is it just wishful thinking?
