So I recently had made a deal with my uncle about buying a motorcycle but the thing is I didn’t have that money to spend so through text messages we agreed to just pay him 500 a month until it’s done. But I never signed anything saying I had to pay I also was given the bike and the title but the thing is that the bike doesn’t even work now and I told him I would not be paying him his money and he needs to come to my home to pick up the bike. Now he’s refusing to get the bike and is saying he would be taking this to civil court. Mind you I have the title and the bike and I never once signed anything about paying him just a hand shake and text messages saying I’d pay him back eventually.

    If you have the title in your name, and the bike, and you agreed to pay him for the bike, you owe him the money. Verbal agreements are no issue here.

    In Florida used vehicles are sold “as is”. Unless your uncle agreed to a warranty OR made a false promise/statement to you in the sale you have no recourse for the condition of the bike

    I mean. You could not be a %**%}{ and honor the agreement. He didn’t sell you a magic bike that would work forever.

    An agreement on price and payments, even via text, is still a contract. If you refuse to pay, you are in breach of contract.

    Unless there was a warranty or guarantee involved in the discussion, the fact that the bike is broken has no bearing.
