I purchased a home in December 2023 and a new construction was going up next door. I noticed they had brought dirt aproximatly 20′ over the property line and had it verbal and in text from the new construction that it would be fixed but unfortunately did not specify what fixed meant.
A little over a year later they had not fixed the problem and I asked them to do it because all of their water was going into my yard since they changed the grade from downhill to uphill going to their property.
Their fix was to bring more dirt in to change the grading, I told them if that does not fix the drainage issue they have to put in real drainage such as a French drain which he now refuses to do and did not fix the issue.
Since they refuse to fix the issues I contacted the city and have a meeting with them today because other than the drainage and what I think is encroachment they also built their house only 7′ from the line when the setback is 10′ minimum.
I also contacted the previous homeowner and they confirmed the neighbor did not have permission originally to fill in my lot. They also told me they witnessed the neighbor getting a survey and the neighbor knows the property lines which the neighbor to me he did not do.
What questions should I ask the city and what should I expect them to do? What should I do to get this problem solved? Is this real estate lawyer territory? What should I do before contacting an attorney to be prepared?
