Location: Nassau County, NY.
I live on a corner property, and I need to rebuild a failing 4ft tall retaining wall that holds up one of my two neighbors backyard. However, the other neighbor has an old, large tree thats literally on the corner of his backyard and the cutting edge of my property line where a good 8 foot segment of the retaining wall is.
The root system is deep and won’t allow me to rebuild according to code (can’t get geogrid in etc.) without damaging the tree. I offered to pay 100% expenses to have it cut down, but they won’t budge. But this wall needs to be rebuilt and is structurally important. Under the law, what are my options?

Is there an easement i. Your back yard at all? Typically if there is concern with flooding/structural damage concerns to weather, the city will put an easement on the area to perform maintenance if needed. I would contact the city and explain the situation to see if they could help you out
