Neighbor is claiming shared fence is hers, and is cutting holes in it and leaving her gate open to let our dogs out. [TX]

We moved into this rent house about 2 months ago and loved the house and the neighborhood. 1 month in though the neighbor yells at us in the morning about our dogs and truck waking her up at 7:30 in the morning and calls us every name in the book including saying she wishes someone breaks into our home and shoots both of us. We didn’t take kindly to this and reported it to our neighborhoor officer who told us she’s clinically crazy and this isn’t new. And also told our property manager who said that she’s already threatened to sue both us and them over these issues.

Our dogs are not yappy dogs in the slightest, and the truck is just an older Chevy that’s louder than a stock truck these days, but by no means loud so she had nothing to stand on. Since she has continued to complain to the management the team about us and threatened to take down the fence and leave her gate open and will call animal control on our dogs if they get out.

Fast forward to last week, she has now cut a 3’x4′ hole in the fence and propped her gate open so she is starting to act on her threats. She has also started to mindlessly bang a hammer for a couple minutes at a time on the fence from around 6:45am until 8:00am. We have called the cops on her for this and they talked to her where she admitted she was making the noise in spite of us since she hates us and our dogs, but they said they can’t do anything since it’s civil.

I’ve talked with both the property managers and the local police about this and am trying to get something done to get her to stop but the cops keep telling us to just keep collecting data on her and the managers haven’t even tried to put something against the fence to block the hole.

So… What can possibly be done about this? We have video evidence of her threats, cutting the fence, and creating all the noise but not sure where to go. She claims the fence is hers since she paid for it and is on her property but I have no way of proving that without a survey and I am hesitant to believe her since she’s made up things before. The fence has been up for probably 20-30 years, it’s hard to tell for sure though but it’s definitely not new. So I’m not sure if there’s some law that can say that if we’ve used it as a property line for so long then it’s a property line itself then it’d be a shared fence for sure. Just looking for any advice since this lady is adding a lot of stress to our days since we’re scared she’ll try and poison the dogs or harm them in some way. Thank you!

TLDR: Neighbor cut a dog sized hole in the fence after threatening many things including to take the fence down in order for her to report animal control on our dogs.

    You should contact your landlord about the holes in the fence. He needs to settle the fence dispute with her. Is there any way to contact the property owner and not just the company?

    In the meantime, if your dogs could escape the yard, then you can’t let them out unsupervised.
