Off duty cop lied on report

r/

Location: California

Salutations, I was on my motorcycle and cut off by an off duty cop in his pv and I collided and was ejected from my bike. He claimed he was on duty and that the car was a city vehicle, but the city I filed the claim with denied my claim because he wasn’t actually on duty and that was not a car that belonged to them.
In the report he was found at fault.

My question is if there is some sort of administrative consequence for him from lying on a police report about being on duty and the vehicle ownership.

NAL: in theory, of course, you could file a complaint with his command and the DA for the city where it happened and there would be some consequence for him. In California, lying on a police report can be a crime, specifically a misdemeanor, under Penal Code 148.5

You can complain to the department and the DA. If he truly falsified a report he could be fired or charged.

That being said, this seems like it was likely more a wires crossed communication error somewhere, since this would be an incredibly stupid and easy to figure out lie. There’s no way the city is going to think his personal car belongs to them. People have done dumber things, but I can’t think what he would stand to gain by telling such a transparent lie.
