Legal repercussions for statements made during cross

r/

So I 25 y/o African American male am the victim in a theft of property case (MacBook Pro). During my interaction with the defendant he ran on foot after recognizing me and went to his car. I chased after him. During cross the defense made the statement “do you think a stranger would be scared of someone of your stature chasing them”. I am use to racist dog whistles due to my line of profession but would never expect to be told this by another professional especially with me being the victim in this case. I then asked for further clarification on what he meant by “my stature” and he retreated and stated of my height. I am 6’1 145lbs. To me this was an obvious ploy to call to question my race. Later the DA spoke with me and apologized for the comments by the defense and was told they would speak with them after. I am wondering do I have any rights or would it be a waste of time to report them for said comments?

Maybe the comment pissed off the jury. It might have led them to believe that there was another reason for the flight.

Potentially helping the prosecution’s case is about it for repercussions.

You are free to report this to the state bar. I’m not sure it is terribly likely to be acted on. And while I understand the context, I’m not completely convinced this wasn’t a reference to height.

The jury knew what that lawyer meant when he asked that racist question. Hopefully it pissed them off too.

I am sorry you had that experience after being victimized.

You handled it perfectly. The jury saw, that is the only thing that matters.
