Can a credit company charge you $3000 then sue you for it, if you never even used the credit.

My family member had applied for and gotten a line of credit to help pay for their dog’s surgery. Due to never receiving the card and some other complications, they didn’t end up using the line of credit at all. Again they never even got a card to use. Since then they have been sending them bills for $3000+ for credit they never had access to let alone used. Now the company is threatening to bring litigation against them if they don’t pay. How can this be legal? They never used the credit.

    No. They can’t sue for credit never used. They would need to show the line was used in some way.

    Obviously there’s some kind of misunderstanding or perhaps fraud here.

    Why does the CC company say they own the money? They used the card? The money went to the vet? Some kind of fee? ($3000 is a lot for fees)

    Has your friend checked the statements and their credit report? A line of credit is only billed for funds that are used, so someone has used it.

    If they don’t have online access to the account, they can request an itemized statement.

    If someone has stolen their card, they can make a police report & file a fraud claim to have it taken off their credit. They should also run credit reports from all 3 bureaus to make sure there are no other fraudulent charges.
