Location: I am in the OKC area and my nephew is in the Ardmore ok area. My Nephew is about five years old and he is in a bad situation. His mother who is my biological sister passed away from Covid in 2022 at the early age of 37.. her and I were both adopted as babies (we come from the same bio mom different dads) and didn’t find each other until we were an adulthood. Anyways when she died, she had a little boy and now the little boy is with his biological father. I went to visit them yesterday and I’m very concerned with how they are living. I am almost certain there’s no electricity, I know for a fact, there are no air conditioners, and I’m not sure if there’s water in the house or not. The father doesn’t have a job or a car and was just denied disability and has stopped fighting that, obviously my main concern is the living conditions of the house. I really feel bad for him, but I feel worse for my nephew. Is there anything I can do or should I just call CPS? Thank you for your time.

Yes call cps. If they remove him you can let them know you’d be willing to take him
You need to start by contacting CPS. You can let them know that you’re available to foster if your nephew is removed, but you can’t file to immediately take custody of a child from their bio father who has full custody.
Call CPS immediately. I’d also consider consulting an attorney. Is there any way to have a conversation with nephews dad? Maybe he would be willing to voluntarily signing him over to you.
