Attorney for trespassing?

Location: Texas

My 17 year old son and his friend were arrested for walking around inside their high school in the middle of the night. I am in shock. He’s a sweet honors kid who doesn’t go to parties or get in trouble.

He’s being booked into jail at 8:00 this morning and will see a judge at some time today.

I hope he gets serious consequences— fines , probation, community service, whatever. But I really don’t want this dumb decision to prevent him from getting into college and I don’t want him to serve jail time along with adults (in Texas, he is an adult at 17)

Do you think we’re need an attorney for this? Or is the charge simple enough he won’t need one? Any words of advice as I prepare myself for this terrible day?

Yes. Your son needs a lawyer.

As you point out, if there’s a chance of avoiding conviction (and applying for college convicted of a crime) he desperately wants that. An attorney give the best chance at some outcome like a deferred adjudication.
