My MIL is an underwriter for the bank me and my husband got our home loan from. I am now getting divorced due to his alcoholism and abuse. Found out in our paperwork for our house there was a sole and separate agreement. She claims she was protecting her investment because she gifted the down paymen

Yesterday he was saying he still loved me and wanting to work stuff out. Today he was telling me he is going to file the papers and we dont need to get lawyers involved. I left the home. He was yelling that I wanted to “take him to the cleaners” because I was upset when I found that paperwork. I left after a big fight where he was screaming at me and throwing things and found a rental where my job was. I moved in a week. They are claiming I planned this and had been planning it for months. I dont know what to do I really trusted and loved both of these people and I am so upset. We are in

Location: New Mexico

which is a 50/50 state and the paper voids that law.

You need to stop making assumptions and call a divorce attorney who will tell you what to expect and what this means for property distribution.

    NAL

Hire a lawyer, state Bar association can help with a referral. It’s going to come down to whether the document is legally binding. Was this a document you signed?

Was it a gift or an investment? I’m confused.

Tell her job. They won’t be happy.
