AITA Tattoo artist wants me to pay for a new chair

r/

Was in for a tattoo today with my sister the other artist told me to sit on the spare tattoo stool while I was waiting so I did but when I sat down the stool toppled backwards n I’ve bruised my back 🥲 bearing in mind the main artist wasn’t in the room. I apologised and she said it was fine I then get in the car to go home and get a message asking for £100 to replace it! I don’t think I should need to pay it as the chair was clearly loose before I sat down 😂😂 bearing in mind this exact stool is £20 on eBay

    > I don’t think I should have to pay for a chair breaking as it was already loose when I sat down on it

NTA, and if you were getting this done in a proper studio and not someone’s back room (please tell me you were doing this through a proper studio), the fact that you fell and injured yourself inside the business, ESPECIALLY when it is because of faulty equipment, then you have the right to sue them for damages.

I’d be responding with “Sure, I’ll be happy to pay for your new stool out of the money I get from suing you, if thats how we want to play this.”

  4. ServelanDarrow Avatar

NTA.  You did nothing unusual to cause it to break.  This is on them.

  5. Previous_Compote_435 Avatar

i would threaten to sue them for damages that there faulty seat caused you to fall and be injured

    NTA.

Well, I’m assuming you’re an average-sized customer. You will know if you have a record of breaking furniture. If you do, then I’d send over the Ebay chair.

If you’re of similar size to the majority of people on the street, then I would ignore the message. You are not responsible for business expenses, such as normal wear and tear on furniture. I bet you won’t have been the only person to have found the stool unstable.

This is why well-run businesses get advice on decor from interior designers. It saves money in the long-run to get well-made furniture that lasts and that customers can use without incident than to have to replace furniture that is inappropriate.

It was a complete accident. If the stool was already loose or damaged, then that’s negligence on the part of the tattoo parlour. If anything, just get them the stool on amazon for 20 like you said, or tell them to get bent.

Tell them you need their liability insurance information, your health insurance company wants to subrogate.

NTA I’d just threaten to sue them for pain and suffering 😅

You are not an AH if all you did was sit down on the stool. Also, businesses have to maintain their furniture and premises, etc.—that’s just the cost of doing business. Unless the customer has damaged property intentionally, they are not expected to pay for property maintenance. Not the AH

  12. Emergency_Comfort_92 Avatar

Tell them you’d prefer to be compensated for your pain and suffering. You’ll hear nothing further about replacing the defective equipment .

  13. Kilbane Avatar

I would ask if they have liability insurance as you got hurt.

  14. Jaded-Citron-4090 Avatar

Have your lawyer send them a letter. Rell them your back hurts and watch the fireworks.

  15. here_for_the_tea1 Avatar

NTA. Don’t pay anything. Don’t respond further. Tell them their lawyer can contact you with any further concerns about your injury that happened in their establishment

  16. lulufan2887 Avatar

I would ask for their insurance company’s information and pursue a lawsuit against the tattoo artist. You got hurt on their premises, on their furnishings. Can’t believe she asked you to pay! In no way was that your fault, and I’d be mad enough to pursue a lawsuit for injuries sustained on their faulty equipment/furnishings. I would consult a lawyer and go to the lawyer’s recommended medical provider to get your back checked out. Hopefully she has insurance for her company, otherwise she’ll be paying for this out of pocket.

Reply back and ask them for video footage and their insurance details.

    That will end the conversation.

How gigantic are you needs to be answered first. If you broke something you should pay for it it it was in working order prior.

  19. NapalEnema2020 Avatar

Then it’s on them to replace their busty ass old stool.

  20. SectorNo9652 Avatar

You got hurt??? Literally you have the upper hand here??

  21. anvil-sun Avatar

Sounds like their negligence injured you. In the US we have many billboards with lawyers advertising for you to call them. Time to cash in!

  22. dmcdd Avatar

Regardless of the answers, it’s their stool and their problem. They offered a seat, and you took it.

    Info:

I’m a big guy (260). I’m careful where I sit, and don’t sit down on anything that doesn’t look like it could handle weight. I don’t mean to be indelicate, but I’m curious if it’s possible you are gravitationally enhanced like I am. If that’s the case, your injuries should probably be your problem, just as the stool is theirs. Everyone goes their own way.

DEPENDS – how does the tattoo look? LoL

“I was hurt in YOUR shop due to your negligence. I can sue you “

  25. sallystruthers69 Avatar

Tell them you want them to pay for your dr visit as you now have back pain.

  26. Possible-Tangelo9344 Avatar

NTA. But, two can play that game. I’d tell them I need their insurance info for my injuries.
