So I 17 male found out a few months ago my current ex friend also 17 had sex with a 13 year old. Their defense was that it was consensual but where we live it is illegal for someone under 15 to consent sex with someone older than 15. Am I the asshole for being defensive saying the 13 year old is a victim of rape

They might both be under age but a 13 year old is closer to a child. That’s weird behavior.

They may be right and it may have been something the 13 year old has nothing but positive and fond memories of. That being said, we need to have an age of consent. It will not fit all, but we need to have it because they wouldn’t know if this would be a traumatizing experience for the 13 year old. So, as the older party, he should have abstained not only because of the law but because of the risk he was putting his partner in.
Would I be calling him a rapist if the 13 year old was an equal partner, there was no weird power/influence/authority dynamic going on and she months later insisted that this was mutual? Probably not. I would still see to that they got in the system. Since they are so close in age and it may be that the 17 year old may be a late bloomer, CPS at least here in Norway can investigate and conclude that no prosecution is necessary. So there is much less drama with “pulling the trigger” by reporting such things.

I wish you’d learn how to put together a coherent sentence – that might help. In response to your question, there’s a very good reason children can’t legally consent to sex. It’s a serious act with serious consequences, and children aren’t generally capable of assessing those consequences for purposes of providing consent.

No, not T/AH. It’s simple math. 17 does not go into 13. And it’s not consensual for a 13 year old to ‘agree ‘ to have sex with a 17 year old. Your ex friend likely groomed, manipulated, or otherwise coerced the 13 year old to have sex. All of these meet the definition of rape.

It is really gross when older teens pray on younger ones. Rapist is accurate. The 17-year-old knew he was preying on 13-year-old who probably felt pressured to engage in the action.
