    Is this about Kilmar Armando Abrego Garcia? AFAIK he’s not an American citizen, but a Salvadoran national with legal protection against deportation to El Salvador.

    No less scary, though. If non-citizens aren’t entitled to due process, then neither are citizens. How, you ask? Because if the government claims you’re a non-citizen, then you have no opportunity to prove you’re a citizen. Legal protections for the marginalized also protect the rest of us.

    Not that it remotely does what they did right, but was the guy in TPS instead of a citizen. AFIK, citizens have rights even when outside the US, and green card holders have some rights, but otherwise it would take action from the government to get him back. They have been ordered to do so by a judge, and are defending their position to not do so.

    Kilmar Armando Abrego Garcia is a Salvadoran national who resided in Maryland. DOJ have admitted their error.  (DOJ) attorney Erez Reuveni, who said he had not even brought that order, later asked for 24 hours to convince his bosses to return the Salvadoran national to the USA. A judge ordered he be returned no later than April 7th.

    There was no proof of the individual being a member of ms 13. The Justice Department has admitted the deportation was an error. The Justice Department now indicates they cannot bring him back due to lacking the power to do so. So much for the power of the American government.

Organized protests of the size we’ve seen since can only be ignored by FauxNews for so long. It’ll be interesting to see if Agent Orange backs down or doubles down. His horseshit tariffs seem to have disturbed his base more than his human rights abuses. They won’t talk about it, but I would guess his base is starting to see real erosion. I’d be glad to see this be the tipping point. We shall see. He has repeatedly shown that he can survive doing shit that would tank regular politicians. Having that base of absolute drooling sycophants helps.

    According to the reports they aren’t refusing the order but are incapable of doing what it orders. It’s unfortunate and they probably should have had a contingency plan in the deal with El Salvador for cases like this. With the mass amount of illegal immigrants and foreign criminals needing to be dealt with it was inevitable something like this would happen and it’s a bad showing for them that they didn’t make plans for this.

    Why can’t they simply just call El Salvador and say “Hey, release that guy?” – They sent him there and, to my knowledge, the prisoner has broken no laws in El Salvador

    We all need to be pissed off and horrified by this. Due process, and “innocent until proven guilty”, is one of the last objectively good things about America. It’s so absolutely absurd to think anyone is in favor of this. Honestly- I think the violation of someone’s Due Process rights should be It’s own crime. If you send someone to jail (slave camp in this scenario) with no due process- you should be given time, and they should be heavily reimbursed. I don’t just want us to get this guy back- I want us to make him rich in the process, because what happened to him is fucked up. I saw the video of the whole El Salvador transfer. That shit is beyond terrifying, they were treated like super villains and one of those dudes didn’t even do anything! It’s fucked and I’m beyond pissed. Bring him the fuck back. How fucking dare they enslave someone and try to write it off as a goddamn “whoopsie”.

    I see it like this. The United States have multiple MS13 and other very very violent gang members who were promoted to come to the United States. It has gotten horrible in some areas of cities now. This administration went on the offensive and got rid of some of the most violent horrible people on the earth. If a mistake was made and I am sure there will be mistake made, they can be corrected.

    What we have right now is many many dudes gone that are now no longer causing major problems in areas. Something I thought I would never see in my lifetime was foreign gang members basically owning apartment complexes and breaking into rooms to kill people. In America….. Something must be done.

Buried in the text of all those executive orders, assuming a court would interpret them as actual law over the Constitution, are several different ways habeas corpus could be considered suspended, and this is the execution of it. I fear a day when ICE just confiscates our IDs and ships off dissenters. No ID because it’s been taken? Gosh must be an illegal.

All laws become suggestions when unenforced, and egotists like DJT don’t listen to suggestions. It’s a harbinger of what’s to come – the public at large doesn’t care about immigrants or people of color, but brutality doesn’t stay in their communities.
    But i’m impotent. I’m one person in a MAGA stronghold state. I write to the congress critters, I talk to my circle about this shit, I try to challenge people’s thinking. But ultimately? I’m horrified by what is being done to him and his family, and I’m pretty sure he’s just the tip of the iceberg.     It made me think of the time Obama unilaterally assassinated a US citizen with a drone in Yemen. Then his own Justice Department was like “Nah, its fine”. It was the first known and admitted extra-judicial killing of a US citizen in history. He was certainly a terrorist sympathizer and propagandist, but there was no evidence he committed any actual violence against the US.

    By similar reasoning, the US could start drone striking any number of US citizen Hamas sympathizers and propogandists today, as long as they were on foreign soil.

    This situation reminds me of that. A huge overstep by the executive branch against a US citizen and a black eye for the US.

    I’m genuinely so confused about the legal status he had in this country.

    He is not a US citizen, so he needed some sort of visa to stay here. He was denied asylum in 2019, which means removal proceedings should have started against him at some point.

    But he did have a work permit. I don’t know what kind or how because he was not in a highly specialized field of work (ie PhD, MD, etc). But does his work permit override his asylum denial? I don’t get how someone can legally work in a country that has denied them residence.

    I do think it’s wrong that he was deported to El Salvador because a judge ruled he would be in danger if he went back. But on the other hand he is literally a citizen of El Salvador. Could the government of El Salvador gotten upset with the US if they found out we deported their citizen to somewhere not his country of origin?

    I’m trying to read and research but there is so much conflicting information about this guy’s case.

    His case was, of course, misreported in the press. That was followed up by even more propaganda. He has been here illegally for 11 years, he has committed crimes in this country, a judge found it credible that he was a member of “tren”. Yes, he was on a hold and should not have been sent back, he shouldn’t have been here under any circumstance. I’m Hispanic, my parents and their family waited 10 years for permission to come here LEGALLY with qualifications such as medical degrees. I have very little sympathy for people here illegally, and less for those that that break the law on top of that when they are here. These people don’t tend to live with the white Upper east side NY, Nantucket liberals when they are here acting idiotic and committing crimes. They are around people like me and my family and we have to deal with them every day. I’m glad he’s gone.

    Horrifying. Our Constitution states everyone in our country & it DOES NOT say US citizens only but ANYONE in our country is entitled to due process. If they can do this to a legal resident, they can do it to a US citizen.
