Long story short I got an at fault accident 23 months ago. Carried valid auto insurance at the time with 25k per person and 50k per accident of bodily injury coverage. Got served papers about a week ago saying I’m being sued for “over $15,000” it didn’t say the exact number from the 19 year old daughter that was in the backseat. She’s claiming things like “headaches and back pain” and “life long suffering” I gave the papers over to my insurance at the time and they said they are dealing with it. I am judgement proof as I have no house. Car is worth under $1,000, less than $500 in the bank and I make between $5-600 a week (I’m a server) I also have children. I was bored and found her public instagram account (no obviously I didn’t contact her or request her it was publicly viewable I’m not that dumb lol) and she’s quite literally thriving. Posting selfies smiling with friends, on boats, out to eat at 5 star restaurants, full body selfies, quite literally living the life with no indications on her photos of suffering. Obviously I know injuries aren’t always in photos but should I send these public photos with the dates and times posted to my insurance as well since it looks like she’s thriving? Im just not sure what’s going to come of this since I literally have nothing to even take and she’s quite literally living her best life.

The burden of proof lies with her and her legal counsel for both immediate injuries and chronic injuries. Insurance companies aren’t stupid and know people will try to sue for as much as they can arguing anything they can, including chronic damage, they’ll know better how to deal with those claims. Leave it to your insurance to handle for now.
