Brother is out of state for work. On his way to a job site he gets thrown off his motorcycle by a pothole. Gets run over by a truck. Lady steals his phone and cashapps herself $4000. wtf do we do ??

We are from Oklahoma. My brother is in Baltimore temporarily for work. He was on his way to work and gets thrown off the motorcycle and run over by a truck. He broke an arm and broke his leg. He lost a LOT of skin/muscle on his calf. Had to have part of his tibia removed and they will be doing a bone graft. He is going to need skin grafts as well.

After he gets run over a lady stops and asks for his phone to call 911. He gives her it with the password and she drives off. Sends $4000 to herself via cashapp/Apple Pay. My mom is an authorized user on his bank account and she’s going to the bank tomorrow morning to report it. Cashapp wouldn’t help her because he is over 18. He isn’t exactly super coherent right now and he doesn’t really know what’s going on.

If the road was fucked like he is saying can he sue the city to any capacity? Also would his work be liable since he is out of state for them and was on the way to the job site? Obv we are going to press charges on this lady that stole the phone but I don’t want anything else looked over in the midst.

    A police report needs to be filed for the phone/money. But does anyone know who she is? The recipient of the money may be her, or it might be another one of her victims whose account she stole.

    Your brother needs a personal injury attorney (obviously needs medical care first) and you may need to see if you can get temporary POA (depending on how lucid he is) or guardianship. Without that, mom may not have any luck at the bank. Are you in touch with the hospital social worker about his case?

    Yes you can sue the city, or the state or county (depending on the jurisdiction of the road, a state highway or a county road or a city road). You’ll have to prove negligence that they knew about the pothole and didn’t deal with it, but it’s not impossible to accomplish.
