Location: Indiana
1) apartment contract does not have a break clause, nor sublease clause about replacement tenants (just dont sublease it out without landlord approval).
Signees remain liable for rent including late fees.
2) I have been paying rent despite not living there (and security deposit was “waived”).
3) 2 potential tenants were found. #1 wants to sign for starting January 2026, but has not yet signed. #2 wants to sign now for current months and onward.
4) #2 was told the apartment isnt available anymore by firstly the roomate, then the landlord. There were not legal reasons except apartment is only available for a few months now, so it doesnt make sense to rent for only few months as someone has signed already.
5) #1 has not signed yet.
6) the roomate simply doesnt “like #2,” and now the landlord doesnt like him being a man.
7) men have been allowed to sign it before, and theres been signees who wanted to move in before January allowed to look at contract. I have not been told by landlord that men, and anyone wanting to move in current year are not longer allowed to sign.
I am aware the roommate does not have a legal power, and #2 doesnt want to sign knowing they dont like him/wont let him sign.
Landlords are suppose to make effort to help find tenants to take over my lease, and gender is not allowed to be a legal reason to deny a leasee, but landlords can have a preference and last say to approve to a potential tentant.
Can/should I request a specific legal reason for denying a replacement tenant? Also, stop paying rent after presenting a willing replacement to take over the current and future months?
