This is for a non officer position. I added my brother as a family reference, not necessarily because I wanted to but because I thought I’d get in trouble with the BI for not adding him.
Him and I are not close, he’s like 20 years older than me and our relationship is strained. I hope he doesn’t respond to my BI because he’s back on his bullshit and he’s gonna say probably bad things about me. Not to say I’m a perfect person, but the ‘bad’ things he believes about me are fiction of his own creation.
Am I overthinking this?

It would definitely raise questions but you should be given a chance to explain.
I know that for my references they said they needed a response from everyone single person I listed! Could be different for each department ofc
It’s been a while, but I used to do backgrounds and almost every applicant had a nut job as a reference, usually someone I found (meaning not on the application). It was easy to filter out.
It might be worth an e mm ail to your BI or recruiter so they know to expect ut.
I’d just get out ahead of it and let them know exactly what you just said. It’s not uncommon for people to not have great relationships with their family
