Car insurance sent their policy limits check but didn’t obtain the release form.

r/

Location: California. I was in at fault car accident.
The other party hired attorney right away. After 6 months, they provided doctors statements, and other documentation to my insurance and asked for their limits (which is 50k). My insurance provided their limits, sent the check, check was cashed, but they are still waiting for release form to be signed and mailed to them.
My worry is 1)since they cashed the check the other party won’t sign the release now; 2) the other party can still sue me; 3)since my insurance paid their limits they won’t represent me in court.
Are my concerns valid?

Valid? Maybe. Are you likely to be sued at this point? No.

The attorney has resolved the case with your insurance, if they wanted to sue you they would’ve done that prior to accepting the limits. It’s possible they are working on an underinsured motorist case with their own insurance. Or maybe the release just got lost in the shuffle.
