Location: Nevada. I went to a certain very popular chain lingerie/sleepwear/clothing/beauty store couple days ago, and when I checked out, the cashier was a man. I thought nothing of it, it did strike me as a little odd but I disregarded it, put my phone number in for rewards like usual, and finished checking out. Days later, today at 9pm, he texted my personal phone number (which I did not give him whatsoever) trying to “shoot his shot” with me. He sent me messages calling me cute and sent photos of himself. He clearly had to have gotten my number from my victoria secret member account since I never gave him it, and now looking back on the convo at the register, he was asking weird questions, like how to pronounce both my first and last name and if me and my friends were done shopping for the night..? This is super creepy and I definitely assume this must be against some kind of store policy to be taking customers phone numbers from their accounts and texting them personally. What would you advise I do next about this? I want to go in and definitely ask for a manager and tell them, but are there any other steps I can take about this? Like anyone else I should contact higher up, or steps I can potentially take legally? Is there anything you recommend I should do to protect myself? Knowing he has access to thousands of girls accounts with their full names, phone numbers, and potentially addresses is seriously concerning me. Thank you!

    It’s not illegal, but it probably violates store policy. In other words, you have no legal remedies, but you can report it to the store.

    It is.

    You can’t compel VS to fire him, or discipline him, or litigate against him until he has verified to their satisfaction that he has not retained any customer information.

    But you can, and should, report that incident to the general manager of the store. Don’t walk in and “ask for a manager”: call and schedule a face-to-face with the general manager of the store.

    Arrive with a dossier: a copy of your purchase receipt, and screenshots of the incoming call and the messages and pictures. The likely outcome is a swift termination of that clerk’s employment.

    While this was employment suicide, it was almost certainly not an actionable breach of privacy or criminal harassment or stalking. It was not criminal for him to attempt to engage you romantically.

    I can guarantee this is against company policy. It’s not illegal to think someone is cute and wants to get to know them, it’s actually complementing.

    However, he definitely crossed the line by not asking you directly for your number. If you report him to the business, he will probably lose his job.

    However, keep in mind he is not going to be happy about losing his job, then you will have another issue. I would have just politely told him to piss off and don’t message me again, then block the number.
