Civil rights violation ?

Hello, I live in a small town where people know each other . I feel that I was treated unfairly by police. My boyfriend and I got into a physical argument. I called the police. I had no marks on me . When he put his hands around my neck, I scratched his face and so I was arrested.

I was dressed for bed in a sweatshirt and underwear. They cuffed me and I felt extremely uncomfortable because my butt was showing. I asked if I could please put on pants and shoes. They said I would get those things when they took me to prison where I eventually ended up.

My minor children were still with my boyfriend * ex now , my mom came to pick them up and he refused to open the door. The police arrived again. When he finally opened the door , my mom stuck her hand inside and told them to come out the door. The boyfriend pushed her back .

The officer then told her that she had entered the house illegally and he could arrest her !

Do I have a case for not being able to put pants and shoes on before they took me to jail ? I was very exposed to say the least .

    No, they aren’t require to give you pants or shoes before arresting you.

    They do not need to wait for you to get dressed before arresting you. This could cause a dangerous situation for them if they allowed people to do that and they have the opportunity to become agressive.

    You would have nothing in FL for a case. It falls under domestic violence laws. And not letting you change isn’t anything as bringing someone into a room is a huge officer safety thing, you could be getting your pants and grab a gun you have hidden in the same drawer.

    Police arrest people in what they are wearing, including their birthday suits.
