Location: Arkansas (I am located in Virginia)
This is a weird one! So I am a resident of Virginia but being sued for defamation in Arkansas. A minor celebrity started a charity having to do with animals (several young animals died in their care) and received a lot of online criticism as a result. They are suing over 10+ people for defamation, defendants are all located in different states.
I am being sued specifically for Facebook and Instagram accounts that I’ve never seen and do not belong to me. This case has been going on for a while now, I’ve signed an affidavit that I am not the Facebook and Instagram accounts, my attorney has told them that numerous times that I am not those accounts but they keep repeating that I am.
Through talking to other people I have found who did own those accounts and it’s just one person. I have them admitting multiple times in some people’s DMs to being those accounts. They deleted the Facebook account (that was attached to the IG account) and since this is a civil case apparently Meta doesn’t participate if you subpoena them for account information.
My question is, what should I do to prove I am NOT those accounts? The plaintiff isn’t trying to prove it, they are just stating it as fact and the court doesn’t seem to care or understand that I’ve said multiple times that I am not those accounts.
PS: thank you for any help here! I am so lost on what to do.. it’s been absolutely maddening to have them quote over and over things the account posted as my words when they’re not.
