I’m in Fresno County, California, and I believe my medical privacy rights were violated, resulting in a denial of housing during a mental health crisis.
On July 3rd, I went to the Fresno County DHS Homeless Assistance Unit to request an extension for temporary housing. I brought a letter from my doctor confirming behavioral health treatment and was asked to sign a HIPAA release form, which I did.
However, before the release was transmitted or reviewed by my provider, the DHS worker called the clinic and asked about my mental health history. The clinic staff provided information over the phone without verifying or viewing the signed release. The information they gave was also inaccurate — they stated I had no upcoming appointments and had only been seen once. In reality, I have an upcoming follow-up scheduled and was prescribed medication during the first visit.
The DHS worker used that information to deny my housing extension. I was not allowed to explain myself, and as I was leaving, the worker mocked me by saying, “Good luck at the Poverello House.” I have filed complaints with CDPH, DHCS, and HCAI.
What I’m asking:
Was this a HIPAA violation by the clinic?
Was DHS allowed to use unverified, inaccurate medical info to make a denial?
Is there a legal basis to file a formal complaint or seek action against either party?
Should I also file with HHS OCR for a federal HIPAA complaint?
I have names, dates, and documentation. I’d appreciate advice on what steps to take next and where to escalate this.
