No kids. Husband doesn’t work or leave the house. I told him I don’t want to be with him years ago and asked him to go live with his parents but he refuses to leave my house (I bought this house and he is neither on the loan or the title). He has mental health issues, but refuses to get help. He has filed for disability twice but is always denied. He is able to work and live a productive life but he doesn’t want to. I’m so unbelievably sick of it.
I filed for divorce 6 months ago and he “appeared” in court within the 30 days but tried to apply for a fee waiver and I guess it was denied. The docket says that it was “incomplete” and mailed back to him in January and since then, there is no movement in the divorce. He refuses to do anything. Can I file a motion for default ruling? The docket says that he did appear or respond to the divorce initially, but since he is not completing the fee waiver, everything has just been in limbo….
Edit: There are no lawyers. I was advised to try to do it without one because if I get a lawyer, husband will have to get one as well and I will have to pay both lawyer fees since husband refuses to work and has no income.

What does your lawyer say?
You can’t afford not to have an attorney – you should be consulting a few and find one you feel comfortable with.
You don’t have the right to remove him from the marital home. If you bought it during the marriage, it’s marital property. If you bought it before marriage but have had a mortgage, it’s also subject to equitable distribution.
