Do i have a case in small claims?

Location: Allentown, Pennsylvania

I had my car’s catalytic converter replaced at a shop called Car Up in June 2024 after they confirmed it was causing a P0420 engine code. The repair came with a 2-year or 24,000-mile warranty.

About a month later, the same engine code returned. I contacted the shop still under Car Up and they acknowledged it was covered under warranty and agreed to fix it.

Recently this week, when I finally had time to bring the car back, I was told the original company had been dissolved and the owner sold the business equipment to one of his employees. That employee now operates under a new name (Heritage Motorworks) and refused to honor the warranty.

However, the new business:
• Operates from the same exact location,
• Uses the same Car Up booking system,
• Displays Car Up signs on street poles, and
• Still appears under “Car Up” when you search online — though it’s now listed as Heritage Motorworks.

Additionally, the current owner is the same mechanic who did the original work on my car.

I am seeking to recover $987 for the failed part and warranty service not honored. I have a copy of the original warranty and screenshots showing that they previously agreed to fix it before the company dissolved

    Read the terms of the warranty. 

    Was it provided by the manufacturer (or rebuilder) of the converter or by the business that installed it?

    If it was the business, was it a specific LLC and/or owner?

    Seems like if the guarantor is refusing to repair there is certainly a valid small claims argument.

    Get in writing the reason the repair is being denied.
