Hello, illegally fired FED here. Fed workers have a ton of legal statue to control/protect us along with other public sector workers in state governments.
- Does DOGE or USDOGES violate 5 USC 322-324 and 5 USC 901 a2 and 5 USC 901 a3? Including the 1994 Federal Restructuring Act?
- The agencies also seem to violate USC 2302 that says that they (agency heads) shall NOT obey an illegal order, including the firing of personnel or allowing an advisory agency to have executive powers (3 USC 411c1).
- Do the firings also violate USC 7103 that mandates a minimum 30-60 day notice before a RIF action is taken? Including how RIFs are not the same as reorganizations as reorgs come with congressional cooperation and evoking 5 USC 903-905? Which hasn’t been used since 1984 and failed to be evoked from Obama and Trump in the past?
- Also agency heads create RIFs, which must be communicated with OPM and human resources in the federal government, with approval, before being enacted?
- The regulatory flexibility act hasn’t been utilized despite its mandate saying when there are executive actions that can adversely affect small businesses, rural communities, and other stakeholders where executive officials must work with state and congressional representatives to determine economic impact before executing these rules? The federal grant freeze and dissolution of contracts seem to violate this. Congressional powers come over executive powers.
Inspector Generals, GAO, and other laws are already doing USDOGES’s intended function, but the key issue is that any sort of restructuring cannot be through the executive at all besides a RIF. RIF must also go through agency heads and be detailed, careful to not violate any laws.
If this is the case, then USDOGES breaks the constitution either by being illegally created, enforced, and executive overheads who are complicit in conducting illegal action are also breaking the law.
