Employers aren’t treating my FMLA request with urgency and my father is dying

I’ve been in contact with management and HR at my company for over a month now, maybe close to two, as my father is dying. At that point, the doctors had given him a timeframe of 3-6 months. As of a couple weeks ago, that got changed to a few weeks to MAYBE a month. My HR department already told me that I qualify for FMLA given the circumstances. I talked to the HR rep responsible for FMLA exactly a week ago, during a company luncheon (we were both still working, though) giving her the updates and his new life expectancy. She told me after the luncheon, when she was back in her office and I was back on the floor, that she would be emailing me the paperwork I needed.

Like I said, that was a week ago. I’ve gotten no emails, and no response whatsoever. I get a text from my sister earlier today that my dad is going downhill, very fast. I’ve been transparent with them and giving them notice for this exact situation not to happen. I feel like this could potentially be a violation of my FMLA rights, but I don’t know for sure.

    Just take the leave and tell your boss. Tell the HR lady “as we discussed I’m taking FMLA leave to care for my father who has a serious health condition. Please send me the required forms.”

    You don’t need to wait for pre-approval. You can take the leave now and send in the forms when you’re able, I think you get at least two weeks to submit it.
